**WAIVER AND RELEASE OF LIABILITY**
**PLEASE READ CAREFULLY – THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS**
**1. ASSUMPTION OF RISK**
I, the undersigned, acknowledge that participation in Brazilian Jiu-Jitsu, martial arts training, and related activities at OB Jiu-Jitsu Collective (the "Academy") involves **inherent risks**, including but not limited to serious bodily injury, permanent disability, paralysis, or death. I understand that these risks may result from my actions, the actions of others, or the condition of the facility or equipment. I **voluntarily assume all risks** associated with my participation, whether known or unknown.
**2. RELEASE OF LIABILITY AND WAIVER**
In consideration of being allowed to participate in training, sparring, classes, and events at the Academy, I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, **waive, release, and discharge** OB Jiu-Jitsu Collective, its owners, officers, instructors, employees, volunteers, representatives, agents, landlords, and affiliates ("Released Parties") from any and all claims, demands, actions, or causes of action, whether arising from **ordinary negligence, premises liability, or any other legal theory**, for injuries, damages, or losses related to my participation in activities at the Academy.
**3. INDEMNIFICATION AND HOLD HARMLESS**
I agree to **defend, indemnify, and hold harmless** the Released Parties from any and all claims, demands, liabilities, damages, expenses, or costs (including attorney’s fees) arising from my participation in activities at the Academy, including claims arising from my own actions or those of others.
**4. MEDICAL TREATMENT AND INSURANCE**
I understand that the Academy does **not provide medical insurance** and that I am solely responsible for any medical costs incurred due to injury. I certify that I have adequate health insurance coverage or the financial ability to cover medical expenses related to participation.
**5. PHOTO AND VIDEO RELEASE**
I grant OB Jiu-Jitsu Collective permission to use my likeness in photographs, video recordings, or other media for promotional purposes, including social media, marketing, and advertising. I understand that I will not receive compensation for such use.
**6. MINOR PARTICIPANTS (IF APPLICABLE)**
If the participant is under 18 years of age, a **parent or legal guardian must sign this waiver on behalf of the minor**. I, the parent or legal guardian, acknowledge the risks of participation and agree to all terms of this waiver. I further **agree to indemnify and hold harmless** the Released Parties from any claims arising from my minor child’s participation.
**7. SEVERABILITY**
If any provision of this waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect.
**8. GOVERNING LAW**
This waiver shall be governed and interpreted under the laws of the State of California. Any legal action related to this waiver shall be filed in a court of competent jurisdiction in California.
**I HAVE READ AND UNDERSTAND THIS WAIVER. I ACKNOWLEDGE THAT BY SIGNING BELOW, I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.**
